1. About the Platform

Chromfinite operates a web-based platform that facilitates:

  • Online counselling services

  • Offline conflict resolution, mediation, and allied professional services

  • Online appointment booking and scheduling

  • Maintenance of electronic records related to sessions

Services are provided by independent psychologists, mental health professionals, and legal professionals engaged in collaboration with the Platform.

The Platform acts solely as a facilitator and does not itself provide medical, psychological, or legal services.

2. Acceptance of Terms

By accessing or using the Website, booking an appointment, or availing any service, you (“Client”, “User”) confirm that:

  • You have read and understood these Terms of Service

  • You agree to be bound by them voluntarily

  • You are legally competent to enter into this agreement under Indian law

If you do not agree, you must not use the Website or services.

3. Eligibility

  • You must be 18 years or older to use the Platform.

  • Services to minors, if offered, require explicit parental or legal guardian consent, to be provided in a manner prescribed by the Company.

  • The Company reserves the right to suspend or terminate access if eligibility requirements are violated.

4. Nature and Scope of Services

4.1 Counselling and conflict resolution services are supportive, facilitative, and advisory in nature.

4.2 Psychological services are not a substitute for psychiatric treatment, clinical diagnosis or treatment, medical care, legal intervention, suicide/harm prevention or crisis intervention

4.3 Legal or conflict-resolution consultations do not automatically create a formal advocate-client relationship, unless expressly agreed to in writing under separate terms.

4.4 Outcomes vary based on individual circumstances. No guarantees are made regarding results.

5. No Emergency Services

The Platform does not provide emergency or crisis intervention services.

If you are experiencing:

  • Suicidal ideation

  • Risk of self-harm or harm to others

  • Severe psychological distress

  • Immediate danger

You must contact local emergency services or appropriate crisis helplines in India.

The Company shall not be liable for misuse of the Platform in emergency situations.

6. Booking, Scheduling, and Appointments

  • Appointments are booked through the online booking system available on the Website.

  • Availability is subject to confirmation by the selected Professional.

  • Sessions are conducted as per the agreed time and mode (online or offline).

  • Cancellation, rescheduling, and refund matters are governed by the Cancellation and Refund Policy, which forms an integral part of these Terms.

7. Fees and Payments

  • Fees are disclosed prior to booking.

  • Payments must be made through authorised payment gateways.

  • All applicable taxes shall be borne by the Client.

  • The Platform may collect payments on behalf of Professionals and remit them in accordance with separate commercial arrangements.

  • Statutory deductions (including TDS, if applicable) may be made as required by law.

8. Electronic Records and Documentation

8.1 The Platform maintains electronic records relating to appointments, session metadata, and professional notes, where applicable.

8.2 Such records are maintained for continuity of care, quality assurance, legal compliance, and administrative purposes.

8.3 Access to records is restricted to:

  • The concerned Professional

  • Authorized Platform personnel

  • Authorities where disclosure is required by law

8.4 Records are handled in accordance with the Privacy Policy and applicable Indian laws.

9. Confidentiality and Legal Disclosure

9.1 Confidentiality is a core principle of services provided on the Platform.

9.2 Notwithstanding the above, information may be disclosed where:

  • Required by law or court order

  • There is a credible risk of serious harm to the Client or others

  • Mandatory reporting obligations apply

9.3 The Client acknowledges that absolute confidentiality cannot be guaranteed in such circumstances.

10. User Obligations

The Client agrees:

  • To provide accurate and complete information

  • Not to misuse the Platform or disrupt its operation

  • Not to record, distribute, or publish any session without written consent

  • To maintain confidentiality of login credentials

  • Not to engage in abusive, unlawful, or unethical conduct

The Client grants permission to the Company to contact them via email, phone, SMS, or other electronic means for service-related communications, including OTPs, confirmations, and scheduling.

11. Role and Responsibility of Professionals

  • Professionals act in their independent professional capacity.

  • They are solely responsible for the advice, guidance, or services provided.

  • The Platform does not supervise or control professional judgment or decision-making.

Professionals represent that they possess the requisite qualifications, registrations, and permissions required under applicable law.

12. Disclaimer and Limitation of Liability

12.1 The Platform facilitates access to counselling, healing, workshops, conflict resolution, and allied professional services. The Platform makes no warranties or guarantees regarding outcomes, accuracy, completeness, or suitability of any service.

12.2 The Client acknowledges that participation in services is voluntary and that use of the Platform and services is at the Client’s own risk.

12.3 The Experts shall provide services with reasonable professional care, consistent with applicable professional standards. Where, in the Expert’s judgment, the Client requires services beyond the scope of counselling, healing, workshops, or conflict resolution, the Expert may refer or redirect the Client to appropriate medical, psychiatric, legal, or other professionals.

12.4 The Expert shall not be liable for outcomes that are materially affected by:

  • incomplete or inaccurate information provided by the Client, or

  • undisclosed or pre-existing medical, psychological, psychiatric, or other conditions,

except in cases of gross negligence or willful misconduct.

12.5 The Company and Experts shall not be liable for any loss or damage arising from technical, electronic, or third-party service failures, including but not limited to:

  • email, WhatsApp, or similar communication tools,

  • Google Meet or other video-conferencing platforms, and

  • payment processing systems.

12.6 To the maximum extent permitted under applicable law, the Company shall not be liable for any indirect, incidental, consequential, special, or punitive damages, whether arising in contract, tort, or otherwise.

12.7 The Platform shall not be a party to, nor responsible for, any disputes between Clients and Experts arising from services provided through the Platform.

13. Intellectual Property

All intellectual property related to the Website and Platform (excluding third-party content) belongs exclusively to the Company. Unauthorized use, reproduction, or distribution is prohibited.
Any worksheets, workbooks, written materials, or other resources shared with the Client during or after sessions are provided solely for the Client’s personal use. Any unauthorized reproduction, distribution, publication, or commercial use of such materials is strictly prohibited.

14. Termination

The Company may suspend or terminate access without notice if:

  • These Terms are violated

  • There is misuse or unlawful conduct

  • Continued access poses legal or operational risk

Termination does not affect obligations that survive by nature.

15. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Courts at [Hyderabad, Telangana] shall have exclusive jurisdiction.
